Article 8 STM …Yes Again!


 I submitted Article 8:

To see if the town will vote to authorize the Board of Selectmen to seek Special Legislation as set forth below: provided, however, that the General Court may make clerical or editorial changes of form only to the bill, unless the Board of Selectmen approves amendments to the bill before enactment by the General Court, and that the Board of Selectmen is hereby authorized to approve amendments which shall be within the scope of the general public objectives of the petition, or take any other action thereon or in relation thereto:

An Act Authorizing the Board of Selectmen in the Town of Templeton to Act as light and Water Commissioners

Section 1. Notwithstanding the provisions of section 21 of chapter 41 and section 56a of chapter 164 of the general laws, or of any general or special law to the contrary, the board of selectmen of the town of Templeton shall be authorized to act as the light and water commissioners and shall exercise all of the powers and duties of a light and water commission as set forth in the general laws.


Section 2. Upon effective date of this act, the terms of the incumbent members of the light and water commission of the town of Templeton shall be terminated and elected light and water commission abolished.

Section 3. This act shall take effect upon passage.”

as a Selectman for discussion  for a number of reasons.

When this article was brought forth for town meeting consideration in March by Dave Smart as a citizen petition, the composition of the BOS was very different. The election of Kenn Robinson and Doug Morrison as well as the hasty and unforeseen resignation of Virginia Wilder, has created a very different BOS.

As I recall, back in March, the TMLWP Commissioners and manager were NOT threatening to shut off water service to the entire town.

Circumstances have changed in Templeton.

Is Article 8 the solution to avoiding a protracted legal battle pitting the Town against the TMLWP?

I don’t know!

What I can assure you of, is that if Article 8 is placed on the warrant for town meeting consideration on June 27th  and voted in the affirmative, THIS selectman would NOT continue a needless, expensive lawsuit AGAINST the TOWN by the TMLWP COMMISSIONERS!

I have not talked with the others members of the BOS about this issue. I have submitted this article for consideration to be placed on the warrant. My motives for this action were to try to a different approach to avoiding a needless and expensive lawsuit against the Town, if Articles 6 and 7 fail at the STM on June 27th.

Tonight the BOS will discuss the articles to be placed on the STM warrant. The discussion will take place in open session beginning at 6:00 p.m.

Thank you, Dave Smart ! You were ahead of the curve, not a very comfortable position to be in.

  1. Where the BOS has to sign warrants for expenditiures by the water dept, is there any way for the BOS to take a vote and curtail any and all expenditures for legal advice by the TMLP?

    Could the BOS take a vote on this matter? If the vote was yes, would the BOS then send a letter advising the L&W commisioners that no more invoices for legal services would be approved?

    1. I may be wrong, but I think the only things the BOS can sign are the paychecks for the men and office staff, working there. That may have changed with the selectmen voting for a partial budget. If I had my way, this guy would have to wait. The Water and Light Commissioners do not give a tinkers dam about the town, but I do hope somewhere in their concience, there is a voice that tells them not to hurt the town, any more than they have. Time will tell. Bev.

  3. I can only hope the people that voted this down last time remember i was ill prepared. I will have to guess the people think a little different about the article this time around. The twisted lies that were told and put out around town are mostly proven to be made up and another thing is the arrogance the commissioners used after are for us all to see. The town i would guess feels like i did when i asked simple questions.We now have a Board of Selectmen that can handle the commission's duties and care about the town and it's money at the same time. Thank you BOS for a Fine job. Also the Advisory Board chairman and members need the CREDIT for pointing out the wrongdoings we are now facing at L+W.The L+W commission has for a long time gone unchecked,unchallenged and finally Templeton has a complete team in place to fix these problems once and for all. Thank you Templeton voters, Please keep up the good work and support the article to abolish the L+W commission. Chapter 93 acts of 2000 was when this all started. Guess who was behind it "ENOUGH"?
