Town officials to seek AG's involvement

TEMPLETON — Town officials and the Templeton Municipal Light and Water Commission remain at odds over the lack of an approved Water Department budget for the coming year following discussion during Monday’s Board of Selectmen meeting.

“We’ve come to a standstill,” said selectmen Chairman Kenn Robinson.

At the May 14 Annual Town Meeting, voters did not approve the water department’s budget following the recommendation of the Advisory Board, which stated that the commission had not submitted a complete budget plan. 


Wilfred Spring, who chairs the advisory board, indicated that the water department budget had only 20 line items, rather than the roughly 65 that is typical. He also stated that the water budget of approximately $1.408 million represents roughly $600,000 more than similar towns surveyed — including Townsend and Lancaster — and pointed out an approximately $65,000 loss the department had planned to address by doubling user rates during one billing period.

“You have a general manager, a business manager, an accountant, a clerical assistant, a foreman, a superintendent and two workers — that’s a lot of overhead, especially when you come up with $65,000 worth of losses,” Mr. Spring said Monday.

The water department asserts that according to its legal counsel — Jack Ferriter of Ferriter Law Firm — the town meeting vote is not binding because the department operates out of an enterprise fund that was created under special legislation.

“There’s a whole hullabaloo because this legislation is not being followed,” Mr. Ferriter said.

However, town officials say the water department has always submitted a complete budget to be approved by town meeting, and is required to do so according to the state laws governing the operation of enterprise funds.

“There’s a presumption of validity behind the actions you’ve been taking for the past 13 years,” said Paul DeRensis of town counsel Deutsch Williams Brooks DeRensis & Holland PC.

With no budget in place for fiscal year 2014 — which begins July 1 — the light and water board’s counsel said the town is forcing the water department to go to court in order to continue its operations.

“We talked to the treasurer and asked, ‘Will you pay the wages and the bills that are due?’ And she said no because the selectmen told her no to,” Mr. Ferriter said. “The board of selectmen is telling the water department they have the fire their workers and shut off the water and the light. The water board wants to go to court to keep it on.”

However, town officials are offering a possible resolution by using the upcoming June 27 Special Town Meeting to seek a vote asking the state’s attorney general to decide who has the final say over the water budget.

As part of a nine-article warrant, the selectmen are submitting an article asking the town to approve a bylaw which states that the water department operates under the state statute for an enterprise fund, and therefore must have its budget approved by the town.

“No lawsuits, no court appearances — the attorney general makes the call. It’s that simple,” Mr. DeRensis said.

Another article will ask voters to provide the department with one-third of the $1.408 million budget sought at annual town meeting.

“We’re putting this article forward as to give the attorney general time to make a decision if article six is successful,” said Selectman Julie Farrell. “This will give the water department a budget with which to work until the special town meeting in the fall.”

“Article seven is a joint effort to send an olive branch,” said Town Administrator Jeffrey Ritter.

The light and water department’s counsel said the board wants the town meeting to vote on its full budget — which officials said now totals $1.413 million due to legal bills following the rejection of the budget — but they do not have a meeting scheduled ahead of the deadline to submit articles for the special town meeting.

In other business, the selectmen will hold a meeting at 6 p.m. Wednesday to finalize the special town meeting warrant.

The board reviewed the nine articles — including requests for expenditures of approximately $47,000 to cover a deficit in the snow and ice budget, and $35,000 for a deficit in the veterans’ benefits account — during Monday’s meeting. The meeting Wednesday is being held to meet the requirement that the warrant be kept open for 14 days.

  1. I think it is important for the people in this town to understand what a good job Mr.Spring and the rest of the Advisory Board have done. For the first time in many years they have worked to make all of the departments accountable for the money they request and spend. Before Mr. Spring became a member, we had a A.V.Board who had no idea of what they were doing. Money was handed out with no questions, and things were bought at will. Gone are those days! Mr. Spring and his fellow members run a tight ship, but that has helped the town departments run efficiently. To do all of the work they have done, and to be ignored by L&W did not go over to well. Things that L&W, could do on the past, do not fly anymore. It was time for someone to draw a line in the sand. To the average tax payer who works hard to make ends meet, they should be happy someone has taken the job of running the town seriously. It is time for Light and Water to get in the game. The people who have faith in them, will not be happy to learn they have been treated like fools. My opinion, Bev.

  2. when they say they talked to the town treasurer it was a letter threat to lay off workers and shut the water off. If they did talk to her it must have sounded odd cause she is a he and always has been. The list of lies grow every day and will come to a head sooner than later. Where were the rest of the commissioners last night,the thought of the 10-14% raises they gave out must have them not wanting to be confronted.
    They told me only 1,1.5,and 2 % raises were given out. management has not had a raise in three years. After seeing the budgets now i know why they didn't turn in the itemized one they were told to!
    I think Mr. Miller had the correct idea Fire the whole team and start over!

  3. when exactly did the selectmen say that the water dept would have to fire their workers and shut off water & Lights? I believe it was MR DRISCOLL who said he would have to shut down the water dept. and lay off employees. It's pretty sad that the light & water dept attorney doesn't have a clue and lies. The really sad think is that we as ratepayer pay for this .........!

I would like to know when The Light and Water Board had a meeting, to decide to ask their council to come to the Selectmen's Meeting, or when did they decide that it was a good idea to threaten the town, and the people who pay their way, with shutting off the water. This board has not has a posted meeting since before the election in May. Sounds like a Open Meeting violation to me. The sad thing is, that people will read that the town is causing a problem, when in fact, they are trying to solve one. Bev.

  4. After a chat with a previous superintendant,it shows me the matter that started this chapter 93 acts of 2000 has a bit of greed involved with its formation. The stories made up and mistruths told then are a major reason to keep the story under control of the L+W commission. The majority of the L+W commission are behind this from day one and will do anything or say anything to keep the power and hire the lawyer that we saw last night, he also was behind this day one. Keep your ears + eyes open and begin to question the motives behind the action at the L+W departments the Town still owns. Time for a better way at Templeton's Light and water. Time to lose the commission and gain some controls!

  5. Citizens of templeton do not have to wait until a STM or any action from any attorney, they should call and write the Ag office and vocie their concern and questions. Contact fox news and get this issue some traction, make some noise and you may get some attention. Call Denise Andrews office and let her know how you feel. Demand action and answers.

    1. The latest, the selectmen's office got a citizen's petition, from Bubba with ENOUGH signatures to go on the STM. This one is asking that the voters pass a article to pay the L&W budget. Not the figures that were brought forward and denied at the Annual Town Meeting, figures that include payment for the lawyer. Enough and his followers don't quit. This lawyer for L&W keeps trying to convince the people that the Selectmen are the ones that want the water turned off. What a crock of sh-t. I pray people are smarter than that. my opinion, Bev.

In speaking with a lot of people who attended town mostly for the school article alot of them were saying that they didn't vote for the water budget because they wanted to see were the money was going. when told that the water dept was gong to shut of everyones water on July 1 the response from all of them was Well hope their ready for a lawsuit because we'll sue them as customers.
