It’s Elementary!

 After the last blog about the Templeton Elementary School Building meeting…Notes from… ,there were some comments made about the contract for $900,000 with the OPM.

MSBA rules and regs have changed since our elementary school project began. One of the new rules when we started the project was that in order to facilitate the feasibility study and get the project to schematic design, communities needed to select an OPM from a list of MSBA approved vendors. So we did. The Templeton Elementary School Building Committee(TESBC) did an RFP and selected Strategic Building Solutions from the MSBA approved list.

The contract with Strategic Building Solutions (SBS) was signed for a total amount of $989,813 (page 28). The vote by the town for a feasibility study was in the amount of $550,000. This contract was signed by former chairman of the board of selectmen, Gerald Skelton on September 15, 2009. This contract was signed by SBS on June 25, 2009. At the bottom of the first page, please note that the contract was stamped “RECEIVED DEC 08 2010”. Received by whom? The BOS? None of this makes sense, unless it was mixed in with the documents from 252 Baldwinville Rd in the white binder.

Notes from the Advisory Board Meeting

At the Advisory meeting last night, chairman Will Spring, started a discussion of the budget guidelines for FY14. There seems to be some confusion on the part of some departments what the term “level funded” means. Level funded means you have the same amount of money as you did last year…the total that was appropriated at town meeting for FY13. Some departments are referring back to ghosts of budget past. Those were the good old days. 

The Advisory Board is recommending a 5% cut from the level funded budget (what was appropriated at the ATM in May) as a starting point for FY14.

The good news from the TESBC meeting held last Tuesday, was that the State ie: DCAM has been conducting soil tests on the parcel of land on southeast side of Route 202 “Crow Hill”. Now that the elections are over, we can focus on submitting a bill to request this parcel of land upon which to build a new elementary school.

The committee had requested an extension (again) from MSBA while we go through the process of obtaining the land from the TDC (Templeton Developmental Center). The extension from MSBA is important because the extension holds our place in line for funding the project. Otherwise, we go back to square one and start over. The state reimbursement for the elementary school project would be reduced from 59.84% to about 30%.

Something to think about‏

I sat at the last Selectman's meeting and tried to put myself in their shoes. I have come to the conclusion that, some times they can not win. I sat behind the two women that have bought houses on Michael's Lane. They are not happy with the work that has been done to improve Gilman Waite. A lot of work has been done to make the fields up there better, a place that the town can be proud of. A good place for all of the kids to play, walking trails for the adults. Ok, now what? I think they are so desperate that they are looking for a loop hole, saying the deed says "for the children of Templeton", meaning that teams from other towns should not be there!! They had some complaints that can be addressed, parking on the roads,

If your turkey is not thawed by now put it in a sink full of cold water.
Allow the turkey to rest about 30 min. before carving.
Remember if you have other things cooking in the oven with the turkey it may take longer than anticipated.
One question I have - does the fluoride boil out of the water??? If not hope all of you are cooking with bottled water. hee-hee-hee

Considering the fiscal condition we find ourselves in, you would think that each and every department would be anxious to cooperate with the other departments. Especially when there is an opportunity to recover tens of thousands of dollars in arrears.  In October the Sewer Department Supt. at the request of the commissioners made a formal request to the Water Department to reconsider its refusal to terminate water service to those customers who were seriously in arrears and who did not enter into a payment agreement.  Below is the response from the Water department Supt. He turned the request around into an attack on the Sewer Department. Had he done is homework he would have realized that there is on file legal opinion stating that it is in fact permissible to discontinue water service for sewer arrears. The Sewer department has also place liens on the customer’s properties. There is little other recourse available. Instead of asking what the Water Dept. do to help, the Supt. and Water commissioners have taken the stance;  “WE ARE NOT GOING TO HELP AND YOU CAN’T MAKE US”  I think the Water department supt. and commissioners live in a parallel universe. They absolutely do not care about the fiscal health of Templeton. If  these people are not working for the benefit of the town, then who are they working for?  Also keep in mind that one commissioner is also on the BOS, and another stood up at town meeting and proclaimed (regarding the fluoride issue) that he “didn’t care what the town voted, they weren’t going to stop fluoride”.   (I personally don’t care about fluoride one way or the other).  This shows the level of arrogance displayed the crowd on Bridge Street. Mr. Driscoll seems very adept at quoting verse and page of the statutes.  How about some cooperation  for the good of the town.

While I am several time zones away, I would like to take a moment to thank the citizens of Templeton for simply standing up and saying they want their government audited. To me, that is what the investigation that was recently voted for at town meeting is. It is quite simply an audit of the way government business, the peoples business, has been conducted for a number of years. Part of this process has already been done a few years back, it was/is called the DOR financial review and yes it also looked at some of the political dynamics within Templeton and how they have or could have affected the town's financial picture. Why would our representatives not vote for that? Why would Chris Stewart say an audit of how business has been done in Templeton for X number of years could bring discredit to Templeton?

Taxpayers of Templeton need clarification:

I see on the blog there is mention of Virginia Wilder trying to make a deal with Kopelman & Paige about their final legal bill. Now whether this is true or not, I believe someone needs to ask selectmen, as in each individual selectmen, if they have looked at the Templeton by-laws? Secondly, do the selectmen feel the by-laws are enforceable and should they be followed by the selectmen? I have been known to look at them and read from them at meetings from time to time and I firmly believe they should be followed by the selectmen. So my next point would be to ask each selectmen what is a settlement? I am harping on this because if true, this would the latest of multiple instances of the same selectmen violating a town by-law. That would be the one about settlements going before town meeting when the settlement will exceed a certain amount. This is on the town's website under town by-laws. Yes I am asking all of you to look this up and read it for yourselves. Part of responsibility of being a citizen and resident of Templeton. My point is if Kopelman & Paige sent Templeton a bill, regardless of any statement about working within the confines of any legal budget, and a selectmen tries to "make a deal" that is reach a settlement, that would again be violating a Templeton by-law and could be seen as treasonous to the town of Templeton and within the duties and oath of office of selectmen of said town. You could toss in high crimes as well sense this may not be the first time for this particular selectmen voting to do this, violate Templeton by-laws while sitting as selectmen. This is reason enough for a recall of this selectmen, Virginia Wilder, if she did in fact try to make a deal. In my opinion, a town meeting vote after the fact does not change the fact that Ms. Wilder, if she did try to make a deal regarding a legal bill over a certain amount, would be violating a town by-law by making a settlement with K&P: K&P issues a bill for X amount of dollars and Ms. Wilder says we do not have that much money but we do have this amount and would you "settle" for that amount? Reason for a recall of Ms. Wilder for willful violation of Templeton by-laws, period.!

As Templeton Turns…number?

 The BOS meeting last night went well. There was a full agenda. We’ve adopted three new policies: The Emergency Medical Dispatch Policy; The WorkZone Safety Policy for the Highway department and the BOS policies and procedures proposed by Selectman Bennett a long time ago!

Under the Police department agenda, Pat Mullins mentioned reverse 911. The Chief mentioned that Reverse 911 is defunct. Code Red is a different system, which we will be using to notify people in emergency situations. This is a different service then the one used by the school system. Code Red works with both landlines and cell phones. People have the ability to opt out if they do not want the messages.

The Highway department has received the bucket truck from the Light and Water department. The old bucket truck is stored at 252 Baldwinville Rd. There was some discussion about what to do with the 1986 bucket truck. We will place the bucket truck on MiniciBid and see what we can get for it.

The BOS discussed compensation for the highway superintendent for snow plowing operations. After much discussion it was agreed to compensate the highway superintendent for plowing when the department is shorthanded. We need to work on adopting the FEMA policy in order to compensate other department heads in the case of a declared state of emergency.

There was discussion about the Fuelmaster system for the highway department. The new system may not be installed and operational until February.

The contract for the FY 2013 CDBG grant writer was awarded to COG. The decision was made to proceed to apply for the CDBG grant to complete the Back Bay project. The design and engineering costs will be paid for out of Chapter 90. It would be nice to complete one project in town.

Budget discussions will take place soon. The BOS came to consensus that aiming for an overall budget reduction of 2% would be the best course of action at this point. The governor may be forced to use 9C cuts to keep the FY13 budget on track. Revenue collections have not met the state projections, which will create a shortfall. On the Federal level, the fiscal cliff or automatic budget cuts will begin in January unless some major agreement takes place. Whatever happens on the state and federal level will have an impact on Templeton. Stay tuned…

Residents from Michael’s Lane were in attendance to discuss the future uses of Gilman Waite field and the impact on the neighborhood. Chris Stewart commented on the addition of the playground is scheduled to be completed next. Parking issues will need to be resolved.

The BOS appointed Dan Keeney as Treasurer from 11/05/12- 6/30/2013. Dan was in attendance and mentioned that he is getting off to a good start.

The BOS approved many licenses last night pending inspections. There are only 2 BOS meetings scheduled in December – December 3^rd and December 17^th. If you know of anyone who owns an establishment that sells adult beverages, please let them know if they want extended hours for a certain occasion (like New Years Eve) they may want to make the request sooner rather than later to the Selectmen’s Office… we are closed on Fridays!!

The winter parking ban is in effect until April 15, 2013. The Christmas Tree Lighting has been set for Sunday December 2. It will start at 4:30 in Otter River.

Senator Scott Brown and the Federal Reserve

Well before the election, I wrote a blog about the Federal Reserve System and the need for an audit. Happy Birthday Federal Reserve was posted in September to Pauly’s blog. I added a comment to the blog to contact our Senators and Congressmen to join a campaign to Audit the Fed. I took my own advice and contacted our congressmen to sponsor the bills (HR 459, S 202). The only Massachusetts senator or congressman to sponsor the bill is Congressman McGovern 7/6/2011(way to go!).

TEMPLETON - New Town Counsel

Many bloggers have not seen this article on Tuesday, November 13, which follows because it was in the Gardner News. It's very impressive.

Paul DeRensis, Templeton's town counsel, was named this month as one of 2012's New England SUPER Lawyers along with two other members of his firm, Deutsch Williams Brooks DeRensis & Holland, P.C. Mr. DeRensis' practice is concentrated in the area of municipal law, and he was one of only 11 lawyers in New England- seven from Massachusetts - given recognition as a Super Lawyer in the government/cities/municipalities law area throughout the entire six state New England region. Mr. DeRensis has achieved this recognition as a "super lawyer" eight times, 2004, 2005, 2007, 2008, 2009, 2010, 2011 and 2012.

The DOR Report

It is interesting that, our Chairman of the Board of Selectmen, Chris Stewart is so afraid that our image as a town would be hurt, that he has not supported the investigation of Article 8, that we as a town voted for on Thursday night. Maybe he does not realize, the towns' image had already been trashed by a previous board in 2009, when they refused to accept the report by the Division of Local Services / Technical Assistance Section, Massachusetts Department of Revenue. Sorry but it is too late to close the barn door, as the cow is running down the road. It is interesting that I walked into a discussion Mr. Ritter was having with our new Town Council,

While everyone is looking at financial, how about some election stuff. ask for minutes of the election registras for say the past 2 years. Ask for the minutes and posting of the meeting of the registras who checked the signatures of the recall sheets for Feb 2012. While it is allowed under state law, ask why the sheets certifying registered voters were not singed by the people who were checking them. Might be nice to have someone under oath attest to the fact that the registras actually did the work rather than someone else. Be sure to check the state law on election stuff and you will see how this process is suppose to work. Remember, you are entitled to look at public records on the spot without a written request, during normal business hours. Maybe a good question for this upcoming meeting of the selectmen is why were receipts recorded without account numbers by the previous town accountant, does this practis mean there is no audit trail? Are there records showing where money came from departments but never paired up with any account numbers? Just a thought / question from over here in vacation land.

More Analysis from the Auditorium

Overall, last night’s Town Meeting was productive and civil, with a few minor exceptions. Of the 100 or so people in attendance, only TWO stood up and spoke out against Article 8 aka “the investigation.” Chris Stewart, who usually does his best to avoid conflict, unpleasantness, and leadership at all costs, seized this opportunity to sarcastically attack Jeff Bennett, a Selectman currently serving in Afghanistan. Well played, Chris! I’m not sure how many people picked up on this between the poor sound system and the audible gasp from disgusted citizens in the audience.

Well guys, we did it. We had our voices heard. How sweet was that. I thank you all so much for the support, not only for tonight, but for the last eight months. You know, we got over that hump, now we need to make the people who have the power, understand the real need to make this investigation fly. We need to make them DO THEIR DAM JOB! Simple as that. Next, in time for the Annual town meeting, we need to make the penelaty for breaking our BY-Laws tougher.

Did you guys know we have been down the road before? Don't know what I mean? Our first battle, the Battle of the Bales.! You know that was in the 70's. A group of guys from Boston area, wanted to start a dump, they came with great promise., one of those get rich deals. The city guys went to Hubbardston, first. Asked the town if they could open a dump, it was a good plan. They were going to bring rubbish into town by rail car. It was a good plan until the people in town, got wind of this grand plan and stopped it cold. From what I have been able to determine, over the years, this group went to Templeton next.

a fun night on Bridge Street

Well things have not improved, at the Templeton Light and Water. You might note that the word municipal is gone from the letter head. The water meeting was first. There was alot of general talk, and finally things got to the fact that the sewer dept had asked the water dept to shut off the water, to the people who will not pay their bills. The attitude of the water part of this business, has not improved one ounce. There was some mud slinning about the water guys, not coming to their meeting to talk to them! OH BOY, AS pauly would say, the gloves came off when Will asked them if they had asked the water dept guys to come? No, these guys could give a sh-- less, and they will not shut off the water. Their solution is to have a lein put on the property, and wait until the property is sold.. The issue once again, , is the failure of the light and water depts., to post their meetings on the town web site.

To the residents of Templeton

Reading an email from Kate Meyers to the Board of Selectmen, I am puzzled why an employee has to beg selectmen to do their job. This is not right and very troubling to this selectmen/resident. Now I read in The Gardner News that Mr. Chris Stewart feels any investigation will bring a lack of credibility to the town? The article states that this is not moving forward. Allow me to digress for a moment. Is it a credible thing to look an organization over and check on procedures, finances and past practices? There is an issue going on in the state of Mass. right now, it involves a crime lab where it appears past practices and procedures may have contributed to wrong doings. Is the state wrong for investigating this? Does that investigation bring discredit to the entire State Police organization? Would some people wish it was never made public? Absolutely, more often than not people or groups do not wish to look bad. A perfect example is when someone got my old court record and posted it in alot of places, other than trying to make me look bad or put into question if I was a good candidate to be representing citizens of Templeton, what other reasons could there be behind that. Rather than hide or ignore it, I put out exactly what had happened and what I have done going forward to "correct" those past not so good actions

 There has been some discussion about Article 8 on the STM warrant for Thursday November 15^th (TOMORROW!!).  Article 8 is a request for an investigation by the Attorney General into four incidents in Templeton:

The purchase of 252 Baldwinville Rd…$700,000

The Casella Settlement…$369,000

Chapter 93 Acts of 2000

WWTP lawsuit and Writs of Attachment… $10-15 million

The Attorney General’s website also has a wealth of information about the Open Meeting Law (OML). There is a way to search for OML decisions rendered by community.

Meetings !!

The Planning Board will be holding a meeting on Tuesday, November 13, 2012 in the Kiva at 6:30 p.m. The agenda has been posted. There is a hearing scheduled for 7:00 p.m. regarding the former Stuart property.

TMLWP meeting will be held on Tuesday, November 13, 2012 at 6:00 p.m. The Light and Water agendas are not posted to the town website. Light department  agenda and the Water department  agenda . There is also a meeting of the Berkshire Wind Cooperative on Tuesday afternoon. Hopefully, there will discussion at the Light Department meting about the PILOT payment. The American Public Power Association has documentation on how to calculate the PILOT payment.

I also have questions about the legal invoices submitted by TMLWP. Usually, a legal invoice will have some detail on it like this invoice from Ferriter and Ferriter. I think it’s curious that the invoices from Doucette & LaRose  for Sept. and Oct. lack any detail at all. Why would anyone sign off on these invoices?

Shedding Some Light …part 3

There will be a meeting of the TMLWP on November 13, 2012. The meetings start at 6:00 p.m. The Water department and the Light department meetings have been posted. There is also a meeting of the Berkshire Wind Cooperative on Tuesday as well. Busy day!

For the TMLWP Light department meeting, there is no mention of the meeting in Princeton last Tuesday of the Massachusetts Municipal Light Department Wind Energy Cooperative Corporation. At this meeting, discussion took place of Princeton Municipal Light Department’s desire to sell its two wind turbines. The Berkshire Wind Coop is a different entity.

Most reasonable people would think there would be discussion at the TMLWP meeting regarding the news that Princeton would like to sell its two turbines and the implications for TMLWP. I was also looking forward to a discussion about the audit for Templeton’s wind turbine.

At least the 2013 Light budget is on the agenda for the Light meeting. I look forward to the discussion of using the American Public Power Association calculations for the PILOT payment to the town of Templeton. I believe it would be beneficial to both the Town of Templeton and the TMLWP to formalize the PILOT payment as suggested by the DOR Review.

Details:	While on Patrol, beware of subject or subjects committing larcenies of manhole covers in the City of Providence. From July of 2012 there have been 150 manhole covers reported stolen to police. In the last 5 days there has been approximately 40 covers stolen with most of the larcenies have accrued in Districts # 6 and District # 7. If any officers see workers working on manhole covers stop and investigate the work being conducted.

Pre-town Meeting Update!

 The advisory board conducted the pre-town meeting last night. A few people were in attendance. There was a quorum so the advisory board was able to vote recommendations on the articles.

The warrant has eight articles. The last two articles are citizen petitions. The Advisory Board took no action on those articles; they do not involve money.

Article 2 was discussed first. The Sewer Superintendent, Kent Songer, presented a timeline regarding the lagoon decommissioning. Another $135,000 is needed to test the sludge in the lagoon. The sludge has already been tested.

The day after election day, boy I am as happy as most of you to see this day come. I would like some feed back on how people felt about our new polling place. In side the building, every thing was peachy keen. It was not as good for many of the elderly,and handicap trying to vote. I saw too many people with canes, parking in front of the school, attempting to go vote, not understanding that they had to walk down the hill, to vote, only to walk back up. It became very apparent that there were problems, when one man stopped near our tent, and said he did not think he could make it back to his car. It got kind of crazy,

Pre-Town Meeting

The Pre-town meeting will be held tomorrow night November 7, 2012 at the Middle School cafeteria at 6:30. The Pre-Town meeting is conducted by the Advisory Board so they can discuss the warrant articles and make recommendations for the special town meeting.

The warrant articles have been posted and include two articles by citizen petition. Information for Article 8 is available from the Citizens4Templeton website. There will be more information added to this webpage before the Special Town Meeting November 15, 2012.

You should know that our town, the Town of Templeton, has made headline news in Boston. Mike Manca, 277 Baldwinville Rd was recently interviewed about a racist, political sign on his property.

Mike Manca has a right to free speech. We all do in this country. So far, that right has not been taken away from us. While I disagree completely with that sign, while that sign disgusts me, Mike Manca has a right to free speech.

I also have a right to free speech. Instead of ignoring the sign and the controversy it created, I am exercising my right to free speech by writing a blog. Racism hasn’t disappeared. It’s gone underground covered by a veneer of political correctness. If you don’t respect the man, Barack Obama, respect the office. The Office of the President of the United States of America.

Working for the good‏

Things are pretty quiet on the blog for the past few weeks. I know Julie, and I have been working to get the people in office, the people who we feel will do our town and country the most good.The election , will be over in a few days. No one will be happier than me. I am so sick of people, down right saying anything, yes anything, that will discredit, their opponent. How do we teach our kids or grand children ethics, if they turn on the tv, to see this stuff going on?

No Second on Fluoride Warning

Well one thing is for sure, no one will ever underestimate the intelligence of Vice Chairman Donald Tourigny when it comes to his knowledge on information concerning fluoride and its effects on our health. At the first Thursday monthly meeting of the Board of Health (BOH) in November, on a motion made (read by Board of Health member Edward Stacy) and not seconded by other BOH members (concerning recommending a warning concerning mixing fluoridated water with infant formula) the BOH failed to vote on said recommendation.

Shedding Some Light…

Lo and behold! I was driving by the Town Clerk’s office and noticed an agenda posted under Light and Water. I pulled over to see what I could see. There is an agenda posted for the (I kid you not) Massachusetts Municipal Light Department Wind Energy Cooperative Corporation (MMLDWECC) Board of Directors Meeting. The meeting of the MMLDWECC is scheduled at 2:00 p.m. on Tuesday, November 6, 2012 at the offices of the Princeton Municipal Light department, 168 Worcester Rd, Princeton, MA 01541. A meeting on Election Day? Isn’t that a big no-no.

At this point, I became very curious why a meeting for a Princeton Municipal Light Department (PMLD) would appear at the Templeton Town Clerk’s office.

Welcome to November 2012, This is one of those months that make you realize you should have spent more time outside in the sun, instead of at your computer writing a blog,or sitting at some of the meetings we have all attended. Really, all that time was important. Just think of all the changes that have been made. I went back to read some of the things I had written or Bart wrote, like in March or April of last year.There has been alot of change, but in some ways, things are still the same! Monday night, at the selectmens meeting they went over the warrent for the special town meeting. When they got to the article we put in, asking for a investigation, no body, in the front of the room bat an eye. This is the time that will tell, if we can get this passed on town meeting floor.

Pauly has tried to get an answer or an investigation into some of the activities in town for quite a while. The citizen’s petition asking for an investigation by the Attorney General has been turned into the town clerk’s office. We are waiting for the signatures to be certified. Hurricane Sandy isn’t helping out.

One of the great concepts of town government is the citizens’ right to petition its town government. If you, as a citizen, feel something is wrong and is not being addressed by your BOS or other department, you can collect signatures of registered voters for warrant articles at town meetings and special town meetings. You, as a citizen, can even gather enough signatures to call for a special town meeting.

Survived Halloween. I ran out of candy! I never run out of candy. The weather was just right…much better than the snow last year! It’s a lot of fun to see the kids dressed up.

So, are you ready to participate? The election is Tuesday November, 6 2012. It looks like the weather will cooperate. I am ready to vote. I’ve looked over the ballot questions. I know which candidates I support and will vote for.

Please take time out to vote on Tuesday. I’ll be working on contact information if you need a ride to the polls.

The voting location has changed from the Narragansett Middle school gym to the Narragansett High school gym. I will check with the town clerk to see if there will be police officers to help direct traffic. In other countries, Election day is a holiday. Go figure!
